(QK7 Online) - Điều kiện nghỉ hưu của sĩ quan, quân nhân chuyên nghiệp, công nhân và viên chức quốc phòng được quy định trong Luật Sĩ quan và Luật Quân nhân chuyên nghiệp, công nhân và viên chức quốc phòng.
Đối với sĩ quan: Tại Điều 36, Luật Sĩ quan quy định: Sĩ quan được nghỉ hưu, khi đủ điều kiện theo quy định bảo hiểm xã hội của Nhà nước; hoặc trong trường hợp Quân đội không còn nhu cầu bố trí sĩ quan, quân nhân chuyên nghiệp, công chức quốc phòng hoặc không chuyển ngành được, nếu nam sĩ quan có đủ 25 năm và nữ sĩ quan có đủ 20 năm phục vụ trong Quân đội trở lên thì được nghỉ hưu.
Đối với quân nhân chuyên nghiệp: Tại Khoản 1, Điều 22, Luật Quân nhân chuyên nghiệp, công nhân và viên chức quốc phòng quy định: quân nhân chuyên nghiệp được nghỉ hưu, khi thuộc một trong 3 trường hợp sau đây:
Một là: Hết hạn tuổi phục vụ tại ngũ cao nhất cụ thể như sau: cấp úy quân nhân chuyên nghiệp: 52 tuổi; Thiếu tá, Trung tá quân nhân chuyên nghiệp: 54 tuổi; Thượng tá quân nhân chuyên nghiệp: nam 56 tuổi, nữ 55 tuổi và có đủ 20 năm đóng bảo hiểm xã hội trở lên.
Hai là: Nam quân nhân chuyên nghiệp có đủ 25 năm, nữ quân nhân chuyên nghiệp có đủ 20 năm phục vụ trong Quân đội trở lên do thay đổi tổ chức biên chế mà Quân đội không còn nhu cầu bố trí sử dụng.
Ba là: Chiến đấu viên thực hiện nhiệm vụ khi đủ 40 tuổi thì được ưu tiên đào tạo, bồi dưỡng và được bố trí đảm nhiệm chức danh khác phù hợp với yêu cầu của Quân đội hoặc được chuyển ngành. Trường hợp Quân đội không thể tiếp tục bố trí sử dụng và không thể chuyển ngành được nếu có đủ 20 năm đóng bảo hiểm xã hội, trong đó có đủ 15 năm là chiến đấu viên thì được nghỉ hưu. Danh mục chiến đấu viên do Bộ trưởng Bộ Quốc phòng quy định tại Khoản 4, Điều 17, Luật Quân nhân chuyên nghiệp, công nhân và viên chức quốc phòng.
